Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tap 'n' Kick (the "Service"), operated by [trading name / legal name and address] ("we", "us", "our"), based in England, United Kingdom. By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. The Service
Tap 'n' Kick is a hosted digital tap-list and bar console: TV/display screens, a touch-screen pour tracker, and an admin panel for managing taps, cellar stock, and pour history. We host and operate the Service; you don't need to run any of your own servers.
2. Accounts
You must be at least 18 years old to create an account. You're responsible for keeping your login credentials secure and for all activity under your account. Tell us right away at [email protected] if you suspect unauthorised access.
3. Plans, Licensing & Acceptable Use
The Service is offered on different plans (currently Free, Home, and Pro), described on our pricing page. Plan features, limits, and pricing may change; we'll give notice of material changes to paid plans before they take effect for existing subscribers.
The Free and Home plans are licensed for personal, non-commercial use only — for example, a home bar, a private collection, or a personal display not shown to paying customers. Any commercial or public-facing use — including in a bar, restaurant, taproom, brewery, or any venue open to customers — requires a Pro plan license. Using a Free or Home plan for commercial or public-facing display is a breach of these Terms.
You also agree not to:
- Use the Service for anything illegal, fraudulent, or harmful;
- Attempt to reverse-engineer, scrape, or gain unauthorised access to the Service or other accounts;
- Resell, sublicense, or provide the Service to others as your own product;
- Upload content you don't have the right to use (e.g. someone else's logo or trademark), or content that's unlawful, defamatory, or infringing.
4. Your Content
You keep ownership of the taproom data, logos, images, and other content you upload ("Your Content"). You grant us a licence to host, store, and display Your Content solely to operate the Service for you. You're responsible for making sure Your Content doesn't infringe anyone else's rights.
5. Intellectual Property
The Service itself — its software, design, and branding — belongs to us. These Terms don't grant you any rights to it beyond using the Service as intended.
6. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these Terms (including the licensing restriction in Section 3), with notice where reasonably possible.
7. Disclaimers & Limitation of Liability
The Service is provided "as is". We aim for high uptime and reliability but don't guarantee the Service will always be available or error-free. To the fullest extent permitted by law, we're not liable for indirect or consequential losses (like lost profits or lost sales) arising from your use of the Service. Nothing in these Terms limits liability where it would be unlawful to do so.
8. Changes to These Terms
We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date; continuing to use the Service after a change means you accept the update.
9. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
